Trademark Opposition

If the applied trademark is found by some one as identical or similar to his owned and in use trademark and he believes that his trademark is being infringed, he can file an opposition within a time period of two months from the date of advertisement/publication in the journal in Pakistan. A Notice of Opposition is required to be filed by the opposer stating the grounds on which he relies for opposing the application.

The applicant is given the opportunity to file his response whereafter opposition is decided by Registrar of Trademarks after hearing the both parties. If the opposer satisfies the Registrar the trademark application is rejected for registration otherwise it is registered.
